This is an appeal by the State of the trial courts order granting appellee James Clive Belchers motion for new trial. The States only argument on appeal is that the trial court erred in granting Belchers motion for new trial because Belcher allegedly did not show properly preserved error that would have entitled him to reversal of his conviction on appeal had the trial court not granted a new trial. Because this argument is premised on an incorrect standard of review and otherwise lacks merit, we overrule the States only challenge on appeal and affirm the trial courts order.
